industrialwastewaterfacilities,washwaterfromfoodpreparationindustries,livestock
truckwashwaterand
solids,vehiclewashfacilities(washwaterholdingtanksonly),
pretreatmentsolidssettledfromwastewaterbeforedischargingtoamunicipal
wastewatersystem,wheyfromcheeseprocessing,sweetcornsilage,sweetcorn
silageleachateandethanolbyproducts.Industriesthatproduceindustrialby
productswhichhavecharacteristicssimilartotheabovebyproducts
mayalsoapply

2.2.12 ThePermittee(s)shallmeasureflowstoensureaccuracywithinplusorminusten

TotalFacilityRequirementssectionofthisPermit.ThePermittee(s)shallmaintain

2.2.13 LimitsandMonitoringRequirements.[Minn.R.7001]
2.2.14 Parameters.ThePermittee(s)shallcollectandanalyzetheparameterslistedinthe
Limits&MonitoringSectionofthispermitforeachindustrialbyproduct.The
Permittee(s)shallanalyzeeachindustrialbyproductindividuallyifitproducesmore
thanonetypeofindustrialbyproduct,unlessapprovalformixingthe
industrialby
productforstorageorlandapplicationisapprovedbytheMPCA.Analysisisnot
requiredforsweetcornsilage.Analysisof"OilandGrease,Total"isnotrequiredat
facilitieswhereoilandgreasearenotpresentinthewastestream.[Minn.R.7001]
2.2.15 AnalysisFrequency.ThePermittee(s)shallrefertotheLimits&MonitoringSectionof
thispermittodeterminetheminimumfrequencyofparameteranalysis.The
Permittee(s)shalldeterminetheminimumanalyticalfrequencyforeachtypeof
industrialbyproductlandapplied.Insomecases,theminimumfrequenciesof
analysiswill
notbeadequatetoobtainrepresentativesamplesandadditionalanalysis

2.2.16 SiteSuitabilityCriteria.[Minn.R.7001]
2.2.17 TheMPCArequiresanindustrialbyproductlandapplicationsitetomeetallthe
criteriainthissection.[Minn.R.7001]
2.2.18 ThePermittee(s)shalldeterminethesuitabilityofthesiteforindustrialbyproduct
application,includingadeterminationthatthesoilsatthesitemeetthesoilsample
limitationsidentifiedintheLandApplicationStationsinthe'LimitsandMonitoring'
sectionofthispermit,andthe'SiteSuitabilityCriteria'of
thissection.ThePermittee(s)
shallsubmitthisinformationtotheMPCApriortolandapplicationandaccordingto

2.2.22 ThePermittee(s)shallsubmitan'IndustrialByProductsSiteNotificationform'as
outlinedintheNotificationProceduressectionofthispermit,includingsoilsand
wasteanalysiscollectedwithinsix(6)monthsofformsubmission.Aftersubmittal,the
Permittee(s)shallcollectandanalyzesoilsampleswithinthethreeyearperiod
prior
toindustrialbyproductapplicationfortheparameterslistedforLandApplication
StationsintheLimitsandMonitoringsectionofthispermit.ThePermittee(s)shall
receivesampleresultsanddeterminesoilsuitabilitybeforeusingasiteforland
application.SampleresultsshallmeetlimitsbeforethePermittee(s)usesasite

2.2.23 ThePermittee(s)shallcollectacompositesoilsampleconsistingofamixtureof
1520subsamplestakenintheplowlayer.Aminimumofonecompositesampleper
siteisrequired.Sitesgreaterthan40acresinsizerequireaminimumofone
compositesampleper40acres
ofarea.Ifusinganalternativesoilsamplingmethod,
thePermitteeshalldescribehowthealternativeprotocolmeetstheminimum
samplingfrequencyrequirementsforcharacterizingsoilsthroughrepresentative
samplingintheSampling,AnalysisandFieldEquipmentCalibrationPlan.Innocase
shalltheproposedsamplingfrequencybelessthantherequirements
ofthispermit.

2.2.24 SoilSuitabilityRequirements.[Minn.R.7001]
2.2.25 Thesiteusedforlandapplicationofindustrialbyproductshallhaveagrowingcrop,
whichisharvestedandremovedduringthecroppingyearthattheindustrialby
productislandapplied.Ifthesitedoesnotmeetthisconditionortheapplicationsite
issetasideland(CRP),
pastureland,nonagriculturalland,ortheindustrialbyproduct
containpathogens,allthesoilsuitabilitycriteriainathroughc,below,shallbemet:
a.Thesoiltextureatthezoneofindustrialbyproductapplicationshallbefinesand,
loamysand,sandyloam,loam,silt,siltloam,sandyclay
loam,clayloam,sandyclay,
siltyclayloam,siltyclayorclay.
b.Thedepthtobedrockshallbeatleast3feet,unlessthesoilclassifiesasahighly
permeablesoil,inwhichcasetheminimumdepthisincreasesto5feet.
c.Thedepthtotheseasonalhigh

2.2.26 TileLines.Onsitesinstalledwithtiledrainage,thedepthtotilelinesisthedepthto
theseasonalhighwatertable.TheMPCArequiressitesmaintainathreefoot
separationdistancetosaturatedsoilsfortiledsites.ThePermittee(s)shallprovide
mapsofthetilingsystemindicatingtheir
depthandplacementinthefield.Water
tablesclassifiedasperchedorepisaturatedbytheNaturalResourcesConservation

2.2.27 ThePermittee(s)shallobtaininformationtodeterminesoilsuitabilityfromtheWeb

characterizationofthesitebyastateofMinnesotalicensedsoilscientistoranother

2.2.28 SiteManagement,Limitations,andRestrictions.[Minn.R.7001]
2.2.29 AnnualApplicationLimits.Annualapplicationratesoftheindustrialbyproductshall
notexceedasodiumapplicationratelimitationof170lb/acre/year.[Minn.R.7001]
2.2.30 HydraulicLoadingLimits.TheMPCAsetshydraulicloadinglimitstopreventponding
andrunofffromlandapplicationsites.Thelimitationsspecifiedinthissectionshallnot
causeanyexceedancesofotherapplicationlimitsofthispermit.Limitsfordaily
surfaceapplicationratesforindustrialbyproductsinclude:
a.10,000
gallons/acre/dayforfinetexturedsurfacesoilswithUnitedStates
DepartmentofAgriculture(USDA)texturalclassificationsofclayloam,siltyclayloam,

2.2.31 WinterApplication.ThePermittee(s)shallmeetthefollowingrequirementsforfrozen
orsnowcoveredsoilswhenincorporationorinjectionisnotpossible:
a.ThePermittee(s)shallnotexceedamaximumhydraulicloadingrateof
15,000gallons/acre/winterforliquidindustrialbyproduct.
b.Applicationsarerestrictedtoareaswith0
%to2%slopes.
c.ThePermittee(s)shallmaintainallseparationdistancesidentifiedinTable5ofthe
appendixtothispermit.TheMPCAassumesindustrialbyproductincorporationor
injectioncannotoccurduringthemonthsofDecember,January,February,andMarch
unlessthePermittee(s)observesspecificfieldorclimatic
conditionsanddocuments

2.2.32 ThePermittee(s)mayberequiredtotakeadditionalmeasurestopreventrunoffofthe

2.2.33 MiscellaneousManagementPractices/Restrictions.ThePermittee(s)shallmeetthe

b.ThePermittee(s)shallnotallow
pondingofliquidindustrialbyproductsafter
6hoursofapplication.
c.Alloftheindustrialbyproductlandappliedshallbeuniformlydistributedoverthe
areaofthesiteusedduringapplication.
d.TheapplicationareashallbeclearlyidentifiedwithGPSmappingusedinthe
applicationequipment,flags,
stakes,orothereasilyseenmarkersatthetimeof
applicationtoidentifythesiteboundaries,separationdistances,andunsuitable
applicationareaswithinthesite.Siteboundariesidentifiedbyfieldroads,andfences,
andsoforth,donotrequireidentification.
e.Theindustrialbyproductshallbeimmediatelyincorporatedorinjected

2.2.34 MultiplePermitteesmayusealandapplicationsite;however,bothPermittee'sannual
reportshallincludeapplicationandadditionalsource(s)ofnitrogen.[Minn.R.7001]
2.2.35 Nuisanceconditions.ThePermittee(s)shallperformlandapplication,stagingand/or
thestorageofindustrialbyproducttominimizeodors,noise,andvectorattraction.
ThePermittee(s)shallprovidereasonableassurancethatthelandapplication,staging
and/orstorageofindustrialbyproductwillnotcausenuisanceconditions.The
Permittee(s)shallconsider
allaspectsoflandapplicationoftheindustrialbyproduct
whenprovidingreasonableassuranceincludingloading,unloading,transportation,
storageandlandapplicationoftheindustrialbyproduct,andshallspecifythis
informationintheSampling,Analysis,andFieldEquipmentCalibrationPlan.

2.2.36 AdditionalRequirements‐IndustrialByProductsSupplyingNitrogen.

2.2.38 Thetotalquantityofnitrogenavailableforcropuptakeforallindustrialbyproduct

2.2.39 Availableorganicnitrogen.ThePermittee(s)shalluseoneofthefollowingmethodsto
determinetheavailableorganicnitrogenforindustrialbyproducts:

considered50%availableduringthecroppingyearitisappliedand25%the
following
croppingyear(carryovernitrogen).
ii.Amineralizationstudyshalldeterminethequantityoforganicnitrogenavailablein
theindustrialbyproductduringthecroppingyearitisappliedandsubsequentyears
(carryover).Themineralizationstudydeterminestherateandquantityoforganic
nitrogenmineralizedduringtheappliedcropping
yearitisappliedandtherateand
quantityofnitrogenmineralizedduringthesecondcroppingyearafterapplication.

ammonianitrogenwhenitissurfaceappliedwithoutimmediateincorporation.

2.2.41 MaximumAllowableNitrogenApplicationRates.[Minn.R.7001]
2.2.42 ThePermittee(s)shallnotapplyindustrialbyproductsatratesthatcause
exceedancesoftheannualmaximumallowablenitrogenapplicationrate.Maximum
allowablenitrogenapplicationratesshalltakeintoaccountallavailablenitrogen

2.2.50 Applicability.Permitteeswithindustrialbyproductscontainingpathogensshallmeet
additionalseparationdistancesandsiterestrictions(Table6oftheappendix).The
MPCAassumesanindustrialbyproductcontainspathogenswhenitcontainswaste
streamsknownorlikelytocontainpathogens,includingwastescontainingblood,
animalfecesandraw

2.2.104 PermanentStorageRequirementsareapplicabletoDewateredIndustrialByProducts
thatarestoredforaperiodofmorethansevenmonthsandarenotstoredinatankor

2.2.105 Thefollowingstandardsapplytothepermanentstorageofindustrialbyproducts:
a.Anyareausedforpermanentstorageofdewateredindustrialbyproductsshallbe

than500gallonsperacreperday,andshallbe
sufficienttobeartheweightof
unloadingandloadingtrucksandequipmentwithoutcracking.Thepadshallbesloped

amannerapprovedbytheMPCA.
b.ThePermittee(s)shallnotstoretheindustrialbyproductat
thepermanentstorage

c.Priortooperationofastoragefacility,thePermittee(s)shallevaluatethepotential

Recommendations
Theserecommendationsarebasedonasinglesilagewasteapplicationrateof100wettons/A.Applicationrates
higherthan100t/Awereinvestigated,howevertheywerenotpracticalduetogreatdifficultyineffectively
incorporatingthesilagewasteintothesoil
andpossibleenvironmentalconsequences.Inaddition,ourfindings
willbesummarizedwithinthecontextofnitrogenavailabilityfromthesilageinordertobeindependentof
specificcropneeds.Itisourintentthattheamountofnitrogenreleasefromsilagewastewillbecreditedtothe
totalnitrogenneedsof
thesubsequentcrop.
First,thefollowingrecommendationsarebasedonthefollowingpropertiesofsweetcornsilagewaste:
1. 18%drymatter
2. Contains1.2%Nitrogen(onadryweightbasis)
Applicationratesupto100wettons/A,whenincorporatedintothesoil,donotposeany
environmentalthreat.
Itisrecommendedthatthesilagewastebemoldboardplowedtoensureadequate
incorporationandsubsequentnitrogenrelease.Chis elplowingthesilagewastedoesnot
provideforadequateincorporationandasaresult,thereislimitednitrogen releasefromthe
silagewaste.
Inthefirstproductionyear
followingsilagewasteapplication,about20%ofthetotal
nitrogencontainedwithinthesilageisreleased.Thistranslatesinto8085lbs.N/Athatis
availabletothesubsequentcropandshouldbecreditedtoitstotalnitrogenneeds.
Inboththesecondandthirdproductionyearsfollowingsilage
wasteapplication,about
6%ofthetotalnitrogencontainedwithinthesilageisreleased.Thistranslatesinto2530
lbs.N/Athatisavailabletothecropandshouldbecreditedtoitstotalnitrogenneeds.
